50/50 Custody in Florida: How the Equal Time-Sharing Presumption Works
Florida presumes 50/50 time-sharing is best for children. Learn how the presumption works, how it can be overcome, common schedules, and child support.

I am Brian Dunmire, a founding partner of Fairway Law Group. My partner, Matthew Waring, and I started the firm to give family law clients representation built on a simple philosophy: resolve what you can, fight when required.
Effective representation does not always mean all-out war, and it does not always mean immediate settlement. What you want to accomplish, and how your spouse or the opposing party responds, should dictate how your case is handled. We built Fairway Law Group around that principle.
My practice is limited exclusively to family law, primarily divorce, modification of final judgments, and paternity cases. I am a litigator, and I enjoy courtroom advocacy. I have been practicing law since 2012, and virtually my entire career has been in litigation, meaning handling cases inside the court system. I am admitted to practice in all Florida state courts, and I am a member of the Family Law Section of The Florida Bar. I earned my law degree from Florida State University.
I began my career defending doctors, hospitals, and insurance companies in medical malpractice lawsuits. Those cases differ from family law, but they put me in high-stakes litigation against experienced plaintiff’s trial attorneys. They also taught me how to take an enormous volume of evidence and distill it into a single, coherent theory that a judge can follow. Trial lawyers call this the “theory of the case,” and it is central to how I prepare every matter.
I then switched sides and represented plaintiffs in personal injury lawsuits: people whose lives were upended by someone else’s negligence. Those cases are almost always defended by major insurance carriers, which defend even clear-cut claims aggressively to limit what they pay. That work taught me that tenacity, patience, and perseverance pay off.
I enjoyed personal injury work, but becoming a father showed me how important families are and how much is at stake when a family goes through a legal dispute. I wanted to help people navigate those issues, and that is why Matthew and I started Fairway Law Group.
Every client has different priorities. For one client, the most important thing is keeping the marital home. For another, it is selling the home as quickly as possible. My job is to listen to what actually matters to you and give you straightforward legal advice on how to get there, even when that advice is not exactly what you want to hear. We will not sell you an outcome the facts do not support, because that leads to a drawn-out, expensive fight that could have been resolved sooner and for less. We take the facts of your case, learn what is important to you, and build a plan to accomplish it.
Florida family law changes constantly through amendments to the rules of procedure, statutory revisions, and new appellate decisions issued every week. A thorough command of current law is a necessity for effective representation, and it is a part of the job I genuinely enjoy. I monitor new case law weekly and follow each legislative session for changes that affect family law cases. I am also involved in lobbying efforts and have traveled to Tallahassee to meet with legislators. During the 2026 legislative session, I drafted a bill addressing a specific time-sharing issue and presented it to a state Representative for review. A bill addressing the same issue was later introduced in the Senate.
Outside the office, I spend my time with my wife, our two children, and our dog. I have played golf my entire life, and I believe sports are a good metaphor for life. Golf has taught me two lessons that apply directly to my practice. First, one bad shot does not decide the round. A case is rarely won or lost on a single fact or a single hearing. Second, pressure reveals character. When a case starts to turn, the right response is to stay composed and execute the plan.
If you are considering retaining Fairway Law Group, I invite you to schedule a consultation with our office. We will learn about your situation and tell you candidly whether your case is a good fit for you and for our firm.
